These Terms of Service ("Terms") govern your use of the pelotista.com website and the booking of tennis and padel programs offered by ASOCIACIÓN DE ENTRENADORES, ESCUELAS Y ACADEMIAS DE TENIS Y PÁDEL ("Pelotista", "we", "us", or "our"), commercial name Valencia Tennis Academy, NIF G09910241, located at Av. Mare Nostrum, 15, 46120 Alboraya, Valencia, Spain.

By accessing our website or booking a program, you agree to these Terms. If you do not agree, please do not use our services.

1. Account Registration

  • You may create an account using your email address or by signing in with Google or Facebook.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You must provide accurate and complete information when creating your account.
  • You must be at least 16 years old to create an account. If you are booking a program for a minor, you must be the parent or legal guardian.

2. Programs and Bookings

  • Program descriptions, schedules, and prices are provided on the website and may be updated from time to time.
  • A booking is confirmed once payment (full or deposit) has been successfully processed.
  • Pelotista reserves the right to modify program schedules, venues, or instructors due to operational needs, weather, or unforeseen circumstances. We will notify you of significant changes.
  • Minimum group sizes may apply. If a program does not reach minimum enrollment, we will offer you an alternative or a full refund.

3. Pricing and Payment

  • All prices are displayed in the currency indicated on the program page (EUR, GBP, or USD).
  • Payments are processed securely through Redsys, Stripe, and PayPal. We do not store your payment card details.
  • Some programs require a 30% deposit at booking, with the remaining balance due before the program start date.
  • Prices are subject to change, but confirmed bookings will be honored at the price paid.

4. Cancellation and Refund Policy

4.1 Private Classes

  • The client is allowed to cancel a private class more than 24 hours before the scheduled lesson without penalty.
  • If the cancellation is made less than 24 hours before the scheduled lesson, the full price of the lesson is charged.
  • This compensates coaches for reserved time and arrangements.

4.2 Group Classes

  • The client is allowed to cancel up to 7 days before the scheduled session without losing the deposit.
  • If the cancellation is made less than 7 days before the class, the 30% deposit is non-refundable.
  • Once the program starts on Day 0, full payment is required. No refund is issued in case of cancellation or withdrawal after the start.
  • After Day 0, cancellations, changes, and rescheduling requests are not accepted.

4.3 Weather and Personal Reasons

  • Classes might be partially refundable in case of rain when it results in more than 20% of missed training time.
  • Makeup sessions are offered on weekends when feasible. Extra fitness hours or theoretical sessions may be offered on request.
  • For padel classes, sessions are moved to indoor facilities when feasible.
  • Classes are non-refundable in the event of player injury or if canceled by the player for personal reasons during the reserved week.

4.4 Rescheduling

  • Before Day 0, the client is allowed to request rescheduling. Approval depends on availability.

4.5 Definitions

  • Day 0: the calendar day the program starts.
  • Deposit: the 30% amount paid at booking.

5. Health and Safety

  • Participation in tennis and padel programs involves physical activity. You acknowledge that you participate at your own risk.
  • You are responsible for ensuring you are physically fit to participate. Consult a medical professional if in doubt.
  • You must follow the safety instructions provided by coaches and venue staff.
  • Pelotista is not liable for injuries sustained during program participation, except in cases of gross negligence on our part.

6. Intellectual Property

  • All content on pelotista.com — including text, images, logos, and design — is owned by Pelotista or its licensors and is protected by copyright and trademark laws.
  • You may not reproduce, distribute, or create derivative works from our content without written permission.

7. User Conduct

When using our website, you agree not to:

  • Use the website for any unlawful purpose.
  • Attempt to gain unauthorized access to our systems.
  • Submit false or misleading information.
  • Interfere with the website's functionality or other users' experience.

8. Limitation of Liability

  • To the maximum extent permitted by law, Pelotista's total liability for any claim arising from your use of our services is limited to the amount you paid for the specific program in question.
  • We are not liable for indirect, incidental, or consequential damages.
  • Nothing in these Terms excludes liability for death or personal injury caused by our negligence, or for fraud.

9. Third-Party Services

Our website integrates with third-party services (Google, Facebook, Stripe, PayPal). Your use of these services is governed by their respective terms and privacy policies. We are not responsible for the availability or practices of third-party services.

10. Privacy

Your personal data is handled in accordance with our Privacy Policy. By using our website, you acknowledge that you have read and understood our Privacy Policy.

11. Governing Law and Jurisdiction

These Terms are governed by the laws of Spain. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Valencia, Spain, without prejudice to your rights under applicable consumer protection legislation.

Términos y condiciones

Estas condiciones regulan el uso del sitio web pelotista.com y la contratación de programas de tenis y pádel ofrecidos por ASOCIACIÓN DE ENTRENADORES, ESCUELAS Y ACADEMIAS DE TENIS Y PÁDEL, con nombre comercial Valencia Tennis Academy.

1. Registro y datos del cliente

  • El cliente debe facilitar datos veraces, completos y actualizados durante el registro o la reserva.
  • Si la reserva es para un menor, la contratación debe realizarla su padre, madre o tutor legal.
  • El cliente es responsable de mantener la confidencialidad de sus credenciales de acceso.

2. Programas y reservas

  • Las descripciones, horarios, ubicaciones y precios de los programas se muestran en la página de cada programa y pueden actualizarse cuando sea necesario.
  • La reserva queda confirmada cuando el pago completo o el depósito requerido se procesa correctamente.
  • Pelotista puede modificar horarios, sedes o entrenadores por necesidades operativas, climatología u otras circunstancias justificadas, informando al cliente cuando el cambio sea relevante.
  • Algunos programas pueden requerir un número mínimo de participantes. Si no se alcanza, se ofrecerá una alternativa o el reembolso correspondiente.

3. Precios y pagos

  • Los precios se muestran en la moneda indicada en la página del programa.
  • Los pagos se procesan de forma segura mediante Redsys, Stripe o PayPal. Pelotista no almacena los datos completos de tarjetas bancarias.
  • Algunos programas pueden requerir un depósito inicial, quedando el importe restante pendiente antes del inicio del programa.
  • Los precios pueden cambiar, pero las reservas confirmadas se respetarán según el precio pagado.

4. Cancelaciones, cambios y reembolsos

  • Las clases privadas pueden cancelarse sin penalización con más de 24 horas de antelación.
  • Si una clase privada se cancela con menos de 24 horas de antelación, se cobrará el importe completo.
  • Las clases de grupo pueden cancelarse hasta 7 días antes de la sesión sin perder el depósito.
  • Si una clase de grupo se cancela con menos de 7 días de antelación, el depósito del 30% no será reembolsable.
  • Una vez iniciado el programa, no se aceptan cancelaciones, cambios ni reembolsos salvo que se indique expresamente lo contrario.
  • En caso de lluvia u otras incidencias meteorológicas, se podrán ofrecer recuperaciones o alternativas cuando sea viable.

5. Salud, seguridad y responsabilidad

  • La participación en programas deportivos implica actividad física. El cliente declara estar en condiciones adecuadas para participar.
  • El cliente debe seguir las instrucciones de seguridad de entrenadores y personal de las instalaciones.
  • Pelotista no será responsable de lesiones derivadas de la práctica deportiva salvo en casos de negligencia grave imputable a la organización.

6. Protección de datos

Los datos personales se tratarán conforme a la Política de Privacidad. El cliente puede ejercer sus derechos escribiendo a info@pelotista.com.

7. Legislación aplicable

Estas condiciones se rigen por la legislación española. Cualquier controversia se someterá a los juzgados y tribunales competentes de Valencia, sin perjuicio de los derechos que correspondan al consumidor según la normativa aplicable.
