These Terms of Service ("Terms") govern your use of the pelotista.com website and the booking of tennis and padel programs offered by ASOCIACIÓN DE ENTRENADORES, ESCUELAS Y ACADEMIAS DE TENIS Y PÁDEL ("Pelotista", "we", "us", or "our"), located at Av. Mare Nostrum, 15, 46120 Alboraya, Valencia, Spain.
By accessing our website or booking a program, you agree to these Terms. If you do not agree, please do not use our services.
1. Account Registration
- You may create an account using your email address or by signing in with Google or Facebook.
- You are responsible for maintaining the confidentiality of your account credentials.
- You must provide accurate and complete information when creating your account.
- You must be at least 16 years old to create an account. If you are booking a program for a minor, you must be the parent or legal guardian.
2. Programs and Bookings
- Program descriptions, schedules, and prices are provided on the website and may be updated from time to time.
- A booking is confirmed once payment (full or deposit) has been successfully processed.
- Pelotista reserves the right to modify program schedules, venues, or instructors due to operational needs, weather, or unforeseen circumstances. We will notify you of significant changes.
- Minimum group sizes may apply. If a program does not reach minimum enrollment, we will offer you an alternative or a full refund.
3. Pricing and Payment
- All prices are displayed in the currency indicated on the program page (EUR, GBP, or USD).
- Payments are processed securely through Stripe and PayPal. We do not store your payment card details.
- Some programs require a 30% deposit at booking, with the remaining balance due before the program start date.
- Prices are subject to change, but confirmed bookings will be honored at the price paid.
4. Cancellation and Refund Policy
4.1 Private Classes
- The client is allowed to cancel a private class more than 24 hours before the scheduled lesson without penalty.
- If the cancellation is made less than 24 hours before the scheduled lesson, the full price of the lesson is charged.
- This compensates coaches for reserved time and arrangements.
4.2 Group Classes
- The client is allowed to cancel up to 7 days before the scheduled session without losing the deposit.
- If the cancellation is made less than 7 days before the class, the 30% deposit is non-refundable.
- Once the program starts on Day 0, full payment is required. No refund is issued in case of cancellation or withdrawal after the start.
- After Day 0, cancellations, changes, and rescheduling requests are not accepted.
4.3 Weather and Personal Reasons
- Classes might be partially refundable in case of rain when it results in more than 20% of missed training time.
- Makeup sessions are offered on weekends when feasible. Extra fitness hours or theoretical sessions may be offered on request.
- For padel classes, sessions are moved to indoor facilities when feasible.
- Classes are non-refundable in the event of player injury or if canceled by the player for personal reasons during the reserved week.
4.4 Rescheduling
- Before Day 0, the client is allowed to request rescheduling. Approval depends on availability.
4.5 Definitions
- Day 0: the calendar day the program starts.
- Deposit: the 30% amount paid at booking.
5. Health and Safety
- Participation in tennis and padel programs involves physical activity. You acknowledge that you participate at your own risk.
- You are responsible for ensuring you are physically fit to participate. Consult a medical professional if in doubt.
- You must follow the safety instructions provided by coaches and venue staff.
- Pelotista is not liable for injuries sustained during program participation, except in cases of gross negligence on our part.
6. Intellectual Property
- All content on pelotista.com — including text, images, logos, and design — is owned by Pelotista or its licensors and is protected by copyright and trademark laws.
- You may not reproduce, distribute, or create derivative works from our content without written permission.
7. User Conduct
When using our website, you agree not to:
- Use the website for any unlawful purpose.
- Attempt to gain unauthorized access to our systems.
- Submit false or misleading information.
- Interfere with the website's functionality or other users' experience.
8. Limitation of Liability
- To the maximum extent permitted by law, Pelotista's total liability for any claim arising from your use of our services is limited to the amount you paid for the specific program in question.
- We are not liable for indirect, incidental, or consequential damages.
- Nothing in these Terms excludes liability for death or personal injury caused by our negligence, or for fraud.
9. Third-Party Services
Our website integrates with third-party services (Google, Facebook, Stripe, PayPal). Your use of these services is governed by their respective terms and privacy policies. We are not responsible for the availability or practices of third-party services.
10. Privacy
Your personal data is handled in accordance with our Privacy Policy. By using our website, you acknowledge that you have read and understood our Privacy Policy.
11. Governing Law and Jurisdiction
These Terms are governed by the laws of Spain. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Valencia, Spain, without prejudice to your rights under applicable consumer protection legislation.
12. Changes to These Terms
We may update these Terms from time to time. Changes will be posted on this page with an updated "Last updated" date. Continued use of our website after changes constitutes acceptance of the updated Terms.
